We are frequently retained by the parents of 'young persons' as they are known in the Children's Court to act on their behalf when they are charged with an offence. Most children charged do not go onto commit other offences. Children often make mistakes as they grow. Some of these mistakes are very serious.
The Children's Court was initially set up as recognition that children needed to be diverted from the adult system and specially treated. We have conducted many serious matters in the Children's Court such as robbery, large theft, extreme violence and driving matters. The penalties are designed to give children a chance to rehabilitate. There are now diversionary programs from the Children's Court and they can form part of the punishment imposed by Children's Court Magistrates.
We have also appeared for children who are dealt with 'at law'. That means that their alleged crimes are so serious that they are dealt with under the full force of the law and subject to the sanctions available under the adult system. Many of the matters we have appeared in involve sexual assault and manslaughter/murder.
