Future Needs - Section 75(2) of the FLA

Future needs of parties may be considered in the Court's discretion when determining an adjustment, if any, to a settlement including:

age and state of health of each party;
income property & financial resources of each party
does a party have care of a child
does a party care for another
is a party eligible for govt. support
reasonable standard of living
maintenance and the effects on earning and training
duration of marriage and affect earning capacity
protecting the parent role
circumstances relating to cohabitation with anotherchild support payable
affect of any binding financial agreements

Section 79(2) makes sure the above considerations are determined in a manner just and equitable.

Full and frank disclosure is necessary.
